The following General Conditions of Sale regulate the offer and sale of products on the site www.nicolinishop.com.
The site is owned by Nicolini Gioielli srl, with registered office in Piazza Saffi 26 – 60019 Senigallia (AN) Italy. VAT number 02970270423, Nicolini is also the owner of the domain name of the site.

1. Purchase orders

The possibility of placing purchase orders on the site is reserved exclusively to adults with legal capacity to act and who have completed the required registration procedures.
Pursuant to Legislative Decree 9 April 2003, n. 70, containing provisions on electronic commerce, the user who intends to proceed with the purchase of products must express this desire through a request made directly on the site where, following the procedures indicated therein, he will place his purchase order and the relative payment. Once the purchase order issued by the user has been received, Nicolini Gioielli srl will send the latter an e-mail, to the e-mail address indicated, as confirmation of the order. Once the purchase order has been confirmed, the buyer has the possibility of verifying the details at any time by accessing his account.

2. Prices, rates and Shipping Costs

The prices of the products are those actually displayed on the SITE at the time the order is placed by the user and are expressed in Euros (€). The prices of the products that appear on the SITE, unless otherwise specified, are inclusive of VAT. Shipping costs and any other possible additional costs, inclusive of VAT and expressed in Euros (€), will be duly highlighted and separately indicated in the order form before the user proceeds to confirm the same. Nicolini Gioielli srl reserves the right to change its prices at any time, but the products will be invoiced on the basis of the rates in force at the time the orders are stored. The products will remain the property of Nicolini Gioielli srl until the user has paid the purchase price, shipping costs and any other possible additional costs.

3. Returns

A) The Customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except for the cases of exclusion provided for in the following point IV. To exercise this right, the Customer must send Nicolini Gioielli srl an email to info@nicolinishop.com or info@nicolinigioielli.it.

ONCE THE RETURN REQUEST HAS BEEN RECEIVED, AN EMAIL WILL BE SENT TO YOU WITH THE WAYNOTE TO PRINT AND ADHERE EXTERNALLY IN THE PACKAGE CONTAINING THE GOODS TO BE RETURNED. PLEASE USE THE SAME PACKAGING AS THE SHIPMENT. Once
the communication has been received, Nicolini Shop Customer Service will open a case for the management of the return and will communicate to the Customer the instructions on how to return the Products, which will take place via the courier indicated by Nicolini Shop.
The right of withdrawal is governed by the following conditions:

I. The right applies to the Product purchased in its entirety; therefore, if the Product is composed of multiple components or parts, it is not possible to exercise the right of withdrawal only on part of the purchased Product.
II. In the event of exercising the right of withdrawal, Nicolini Gioielli srl will refund the customer the entire amount of the returned goods, including shipping costs where applicable, within 14 days from the date on which the notice of withdrawal was received, without prejudice to the right of Nicolini Gioielli srl to suspend payment of the refund until the goods have actually been received. The refund will be made using the same payment method used by the Customer, unless the latter has expressly requested a different method. In the event of a bank transfer, the Customer will be responsible for providing the bank details on which to obtain the refund (account holder, name and address of the Bank and IBAN).
III. Also in order to guarantee free returns pursuant to the following article 8, the Products must be returned in the same box in which they were received.
IV. In addition to the cases indicated in the Introduction (customer who is not a consumer and/or who requests an invoice), the right of withdrawal is excluded in the following cases, pursuant to art. 59 of Legislative Decree 21/2014:

- order of Products packaged to measure or clearly personalized;
- order of Products that are liable to deteriorate or expire rapidly;
- order of sealed Products that are not suitable for return for reasons of hygiene or related to health protection or that have been opened after delivery.

With reference to the cases of exclusion of the withdrawal listed above, the Customer, in particular, is informed and accepts that among the Products that "risk deteriorating or expiring rapidly" are included both all food Products (including wines, spirits and beverages) and cosmetics, as the characteristics and qualities of these types of Products are subject to alteration also as a result of inappropriate storage. Therefore, for reasons of hygiene and protection of Customers, the right of withdrawal is applicable only for Products purchased on the Site that can be returned to Nicolini Gioielli srl and put back on the market without danger to the health of consumers (such as books, gadgets, kitchen utensils, etc.).

B) Pursuant to art. 14 of Regulation 524/2013, the user is informed that in the event of a dispute, he/she may submit a complaint via the European Union ODR platform, which can be reached at the following link https://ec.europa.eu/consumers/odr/ (the platform has been operational since 15 February 2016). The ODR platform is an access point for users who wish to resolve disputes arising from online sales or service contracts out of court.

4. Availability of products and services

The products offered on the SITE are limited in number. It may therefore happen, also due to the possibility that multiple users purchase the same product at the same time, that the ordered product is no longer available after the purchase order has been sent. In the event of total or partial unavailability of the product or service upon receipt of the order, the user will be informed by email with the proposal to:
•delivery of a partial order, with reimbursement of the missing product;
•replacement of the missing product with one of similar or superior characteristics
•cancellation of the order with a total reimbursement.
If the user chooses to be reimbursed, Nicolini Gioielli srl will reimburse within 15 days of the request. The amount reimbursed will be equal to the amount paid, including shipping costs. Any delays in crediting may depend on the banking institution, the type of credit card or the payment solution used. In the event of impossibility to credit the amount to the credit card or payment solution adopted by the customer, the refund will be made by bank transfer, upon communication by the user of the relevant coordinates and IBAN code. Neither party will be responsible for the failure of the order in the event of force majeure, such as strike, natural disaster, terrorist attack, war, problems affecting suppliers, transport or production, measures taken by public authorities and similar. In the cases listed above, both parties are entitled to a reasonable additional period to fulfill their obligations. However, if the circumstances in question last more than 60 days, the buyer may cancel the order by written communication to the supplier.

5. Delivery of products

Deliveries will be made in the territories indicated on the website www.nicolinishop.com, in the shopping cart section. The indicative delivery times for each product will be specifically indicated in the individual product sheet or during the purchase procedure and, in any case, before completion of the same. They will also be indicated in the SHIPPING section of the SITE. The delivery of the purchased products may take place, at the user's choice:
•to the postal address indicated by the user as domicile;
•to the alternative postal address, requested in the order form.

6. Shipping

Shipping is carried out when all purchased items are available. The costs, paid by the buyer, are calculated automatically by our Ecommerce system based on the destination and weight of the goods.
Upon delivery of the products to the courier, the user will be sent a shipping confirmation email in which the tracking number will be indicated through which he can check the status of the shipment. Each delivery is considered completed from the moment the courier makes the products available to the buyer, as resulting from the system used by the carrier to track shipments.

The credit card data are entered directly on the pages of the banking partner of Nicolini Gioielli srl and are transmitted to the bank's servers in encrypted form according to the 128-bit SSL (Secure Socket Layer) standard, one of the most advanced and effective protection systems currently available. For greater security, only the banking partner has access to the data of the card used for payment, while Nicolini Gioielli srl has no possibility of knowing or storing such data. Each user guarantees that he or she is authorized to use the credit card or his or her PayPal account to pay for the Order and that such means of payment allow access to sufficient funds to cover all costs relating to purchases of products through the SITE.

8. Protection of personal data
Nicolini Gioielli srl guarantees the user that the personal data acquired in relation to the sale of products will always be processed lawfully and correctly, in full compliance with the provisions of Legislative Decree 30 June 2003, no. 196. For any information relating to the processing of personal data, please refer to the "Privacy Policy" section and the information on data processing provided by Nicolini Gioielli srl, pursuant to art. 13 of Legislative Decree 196/2003, to the user at the time of registration on the SITE. The user guarantees that the personal information provided during the registration procedure on the Site is complete and truthful. The user agrees to hold Nicolini Gioielli srl harmless from any compensation obligation and/or sanction deriving from and/or in any way connected to the violation by the user of the rules on registration on the Site.

9. Effectiveness and modification of the General Conditions of Sale

These General Conditions of Sale apply to all sales made on the SITE and may be modified at any time. Any changes and/or new conditions will be effective from the moment of their publication in the "Conditions of Sale" section of the SITE. The applicable General Conditions of Sale are those in force on the date of sending the purchase order.
These General Conditions of Sale do not regulate the sale of products and/or the provision of services by parties other than Nicolini Gioielli srl that are present on the SITE via links, banners or other hypertext connections. Nicolini Gioielli srl is therefore not responsible for the contents of such sites nor for any errors and/or omissions and/or violations of the law by the same.
